PROCEDURE FOR ADOPTION OF VIETNAMESE CHILDREN

 


1- SUBJECTS: 


- Vietnamese resident(s) in Canada or Vietnamese-Canadian Citizen(s); 
- Canadian citizen(s)

2- CONDITIONS FOR ADOPTIVE PERSON/PARENT(S): 


- Having full civil capacity; 
- Must be at least 20 years older than the prospective adoptive child; 
- Having good record of ethics; 
- Must be fully capable of providing the adoptive child(ren) with proper care and education.

3- CRITERIA FOR WOULD-BE AD0PTIVE CHILD(REN): 

- Must be under 15 years old. If older, the adoptive child must be handicapped or lost the capacity of civil acts or the adoptive parents being old and feeble, living alone; 
- Living in fostering foundations which legally established in Vietnam; 
- Living in a family if he/she is an orphan or disabled, or he/she is a native of the adopter.

4- ADOPTIVE DOSSIER: 

Each adopter or adoptive couple completes 02 adoptive dossiers, including: 
Application for adoption (download form 03-TP/HT-NN), attached 01 adopter(s)’ photo (passport size-less than 3 months).Please fill out all details
* If adoptive person is married, an agreement of the spouse on the adoption must be obtained. 
Photocopy of passport or equivalent documents of adoptive person/parents (enclosed with the original or certified by Notary Public or Commissioner or lawyer); 
Permission or Certificate on adopter’s eligibility for the adoption being in accordance with the Canadian laws issued by Canadian authorities less than 6 months from the date of dossiers receipt, obligatorily sealed by the Department of Foreign Affairs of Canada
Medical Certificate issued by a Canada competent Medical Organization less than 6 months from the date dossier receipt, certifies that adopter(s) is/are healthy, free from mental illness, transmitted diseases, obligatorily sealed by the Department of Foreign Affairs of Canada
Certification on annual income, issued less than 6 months from the date dossier receipt, certifies that adopter(s) has/have financial means for bringing up adoptive child, obligatorily sealed by the Department of Foreign Affairs of Canada
Adopter’s Police Clearance (or Justice record) issued by Canadian authorities less than 6 months from the date of dossiers receipt, obligatorily sealed by the Department of Foreign Affairs of Canada
Commitment of annual report (download form 04-TP/HT-NN) on the situation of the adoptive child’s development until the adoptive child’s age is 18 years old (The Commitment must be certified by Canadian authorities); 
- Home Study issued by any Canadian Adoption or Social Association obligatorily sealed by the Department of Foreign Affairs of Canada
- Marriage Certificate (If any) obligatorily sealed by the Department of Foreign Affairs of Canada
In case of submitting the adoptive dossier at the Vietnam Embassy in Ottawa, please enclose following additional documents: (Only in cases that the adoptive child is now in Canada or does not have permanent address in Vietnam, and has permission of the International Adoption Bureau - Ministry of Justice of Vietnam). 
- Birth Certificate of the adoptive child; 
- 2 colour photos of the adoptive child, with size 10 x 15 cm or 9 x 12 cm; 
- Written consent by would-be adoptive child’s parent or sponsor voluntarily agree their child to be adopted by a Canadian citizen. If the adoptive child is 9 years old or older, his/her consent must be obtained; 
Medical Certificate issued by a Canada competent Medical Organization (where the adoptive is living) on this child’s health, indicating special situations if any; obligatorily sealed by the Department of Foreign Affairs of Canada
- Documents that allowed the adoptive child to reside in Canada. 

5- FEES: At the current fees 

6- NOTES: 

All documents need to be legalized and translated into Vietnamese (if required) (except for copies of Passport or equivalent documents, application for adoption, commitment for report …,which do not need to be translated into Vietnamese). 
- All the above-mentioned documents are required in English
- All the above-mentioned documents need to be sealed by the Department of Foreign Affairs of Canada before sending to the Embassy of Vietnam to legalize.
